Sew & Tell Australia Program Terms and Conditions

Sew & Tell Australia is an exciting and educational online sewing business offering sewing-related content, patterns, tips, classes, courses and programs (collectively referred to as ‘Programs’) for you. Sew & Tell Australia is thrilled that you are keen to expand your sewing knowledge and skills and create new projects. Sewing should be a joyful experience and Sew & Tell Australia want to help create that enjoyment for you. Sew & Tell Australia provides these Programs for you for educational purposes.

These terms and conditions apply to the Programs offered by Sew & Tell Australia ABN 66 978 702 127 (referred to as ‘Sew & Tell Australia’, ‘we’, ‘us’, or ‘our’). These terms and conditions are to be read together with our Disclaimer https://sewandtell.com.au/disclaimer/ and Privacy Policy found at https://sewandtell.com.au/privacy-policy/ any other formal written terms published on our website or written agreements between us. These documents together form our entire agreement with you.

These terms and conditions will become binding once you agree to proceed with any of our Programs, use our Programs or make payment for our Programs.

Enrolment in the Sew & Tell Australia Programs

Sew & Tell Australia provides online educational Programs, including tips and other content, for your enjoyment and education. These Programs are designed for participants of varying skills and experience who are interested in expanding their sewing knowledge and abilities and being connected with a sewing community created by Sew & Tell Australia.

All of the Programs are online and run virtually. Some Programs have live sessions and you will be notified at the time of purchase if the session is to be run live. A live session may include other sewing enthusiasts who are also participating in the same Program.

As part of the online booking and enrolment process, you will select the Programs of your choice at the time of booking. Unless it is a live session or otherwise stated, you are able to work through a Program at your own pace and can revisit it multiple times.

The Program fees for each option are listed on our website and you agree to pay for the Program in full, by selecting the payment method that suits you, at the time of purchase. If you do not make payment, you will not be granted access to any the Programs.

Please ensure that the enrolment details (such as your name, address and email address) you provide to us are accurate and up to date. It is your responsibility to update any of your enrolment information for your online account profile, including your email address.

Please ensure that the email address you use is current, accurate, and accessible, as it will form part of your member login details. It is through your email address that we can reset your account, and you can access online events, so please ensure you are accurate. We cannot be held responsible for inaccurate email addresses and there will be no refund offered if you then miss the event due to your email address being entered incorrectly by you.

Please note that your login is unique to you and not to be shared with anyone else. Any unauthorised sharing of login information or your membership benefits will result in termination of access to our Programs, without refund.

Our Programs will run in accordance with the details on our website https://sewandtell.com.au/ (‘Website’). The Programs we offer may vary, so please check our Website frequently for the latest Programs, including any exhibitions (‘expos’) or collaborative events with other sewing enthusiasts.

You may enrol in more than one Program, provided you complete the online booking process for the new Program and make your payment. You will be then given online access through your registered email address.

What to expect and what do you need

The Programs are designed to be a fun and exciting experience and may include sewing a new Pattern, using different fabrics, using different sewing machines or general tips and techniques that we have found helpful.

Wherever a Program includes a Pattern, you may need to pay an additional amount to the Pattern provider, depending on the Program and what you may be sewing. Please note that no physical pattern will be sent to you and will be in electronic format only.

Any measurement conversions or sizing adjustments need to be completed by you and we recommend you seek additional assistance from a local guide in your location or online, where necessary.

The Programs are intended for participants who have access to the internet, basic computing knowledge and a general knowledge of sewing and a sewing machine of their own. Each participant must also have their own sewing materials, including thread, needles, fabric, and other sewing accessories.

We want you to have an enjoyable experience, but we cannot guarantee any specific results from participating in any of our Programs and you must evaluate if the Programs are suitable for you before you proceed.

We may offer Lifetime Access on selected Programs and our patterns and this will be stated at the time of purchase.

Please note that in some circumstances, a Program we offer may be withdrawn, and this includes any with Lifetime Access. In this instance, we will notify you and you will have twelve (12) months from this notification date before your access will end. This will give you the opportunity to download any course materials before the end date. Once the twelve (12) month grace period has ended, access will no longer be granted and no refunds will be made available.

If you would like to raise any concerns during the Program, please put your concerns in writing and we will endeavour to respond to you within fourteen (14) Business Days.

Pre-Sale of Online Event Access

We may pre-sell tickets to special sewing modules, classes or events and your access date may be subject to change due to any unexpected emergency that may arise. Whilst every care is taken and alternative options exhausted, in the event that we need to change the date, we will notify you and provide you with the rescheduled date and time.

If you enrol for a live online session, Program, or other online event that is stated as not recorded, no refunds will be issued where you inadvertently miss the event and cannot access any recording. Sew and Tell Australia cannot issue a refund to you if you do not attend online at the scheduled date and time.

Payment

Our fees include GST, if applicable, and are charged in accordance with fees advertised at the time of purchase for the Program.

You may purchase our Programs in either United States Dollars ($USD), Australian Dollars ($AUD) or any other currency offered. Please select your applicable currency at the time of purchase.

You may make payment via the authorised payment platform we have set up on our website. This may include ThriveCart, Stripe, PayPal, Afterpay, ZipPay or any other similar payment processing platform. If the platform is not listed on the website, it is not currently available.

Please note that you may need to restart your device in order to access any of these third party payment processing platforms.

If any payment is dishonoured for any reason, you will be liable for dishonour fees. If money remains unpaid, you will also be liable for any costs and disbursements that we incur in pursuing the debt (including legal costs on a solicitor and own client basis) and debt collection costs to the extent permissible under relevant legislation.

Cancellations and Refund Policy

– Please consider your purchase carefully. After you have paid for our Program/s and paid the Program fees, we cannot refund you if you simply change your mind. This is due to your access, the time spent in administration, planning, and allocation of our tailored resources to your participation.

– We do not offer a refund or a partial refund if you cannot attend the Program or any part of the Program due to reasons outside of our control.

In the event of special hardship or exceptional circumstances, at our discretion, we may release you from the Program. To apply for this special provision, you must set out your circumstances in writing, with additional supporting documentation, such as a medical report. In these circumstances, we may provide a partial refund of the unused session fees, less an Administration Charge.

We reserve the right to cancel or suspend your placement in our Program at any time with seven (7) days’ written notice if we believe that you have failed to comply with these terms and conditions. Suspensions may be up to fourteen (14) days unless otherwise agreed in writing. Cancellations will be made for a serious breach of these terms and conditions.

We will not provide a refund if your placement in our Program is terminated for serious non-compliance. In no event will we be liable for any loss or damage as a result of terminating your placement in our Program due to your failure to comply with these terms and conditions.

Sew and Tell Australia may experience technical difficulties in presenting a live event, Program or other course, outside of our control, and may need to be subsequently rescheduled to an alternate date and time. Sew and Tell Australia will notify you of the rescheduled event or Program, however no refunds will be issued if you cannot attend the rescheduled date and time. If the event or Program cannot be rescheduled by Sew and Tell Australia, a refund may then be offered.

Photography and Video

As part of our Programs, we may take images and photographs and/or video footage of you, including interactions with other participants, such as in a live session. If you do not want to participate in any recorded image or video, please notify us before the live session commences. We cannot edit you out of a recording at a later date.

We may also display testimonials and/or comments from our social media accounts, website, live events or other promotional activities, and use these for marketing purposes. Please note that we may blur your photo and/or name where necessary to protect your identity.

These images and videos may be used for our promotions, website, social media, advertising and other resources in our Program, including Third-Party Services. You consent to our use of these images and videos and agree you will not be renumerated for our use of these.

Health and Safety

You warrant that you remain entirely responsible for your own safety at all times, including any physical capabilities, disabilities, allergies, and any other special needs at the time of enrolment. We cannot be held responsible for your use of your own materials and equipment.

You agree it is entirely your responsibility to seek medical assistance or apply first aid in the event that you suffer an injury whilst using your own equipment, when participating in any of our Programs or events, where necessary.

Intellectual Property

All intellectual property rights in our Program, remain our property. Enrolling in our Program does not give you any ownership rights to our Program resources or any other Program material.

You are only permitted to use the Program materials for your own personal use, such as sewing your project, and only whilst enrolled in the Program. You must not share, distribute or resell, in part or in full, those Program materials without our express prior written permission. You are prohibited from using our Program materials to develop your own Program or training for sale or giving away to others. You may not use our techniques, methods and intellectual property outside of the Program or the purpose of which it was intended.

Please note that you are not permitted to take screenshots, or recordings of any kind, of any of our Program contents, and share these with anyone who has not enrolled and paid for the Program.

Please note that some of our Program contents may include our authorised use of the intellectual property of another party and you are not permitted to sell or use these outside of the Program or for outside of the purpose of which it was intended.

Third-Party Services

We may give recommendations, including but not limited to, third-party products, patterns, programs or services, (‘Third-Party Services’), due to the systems we use, or because to the best of our knowledge, they are quality products or professional service providers. This may include educational applications or any event applications. This is subject to change over time.

You remain responsible for your own use of any Third-Party Services and associated costs, and must first complete your own due diligence, including agreeing to the Third-Party Services terms and conditions.

We will not be liable or responsible for your use of Third-Party Services, or loss or damages you or any other person suffers due to the use of the Third-Party Services.

Please note that if you are having accessibility issues with any Third-Party Services, you may need to restart your device or troubleshoot directly with the Third-Party Services.

Limited liability and indemnity

To the fullest extent permitted by law, and without limiting the application of relevant consumer law, in the event of any fault in the services, our liability will be limited, at our choice, to:

supplying the services again;

repairing any fault in the services caused by us;

payment of the cost of having any fault in the services caused by us repaired; or

payment of the cost of having the services supplied again.

You agree that our total aggregate liability for any claim(s) by you relating to any Program we deliver to you is limited to the amount actually paid by you to us for that Program.

Unless the claim was caused by or substantially contributed to by us, or the cause of the claim was outside of your control, you agree to indemnify us and hold us harmless against loss or damages suffered by you or any other family member arising from your breach of these terms and conditions. This means if you cause a claim, you will be responsible for the costs we incur to defend that claim.

General

Notices:

Any required notice between the parties, including a notice of dispute, may be provided electronically in writing to the email contact details notified in the schedule, or as later notified in writing.

Notices sent electronically are deemed to have been received on the same business day if sent prior to 4.00pm in Melbourne, Australian time, on that business day and otherwise, the next business day (where a business day is a day that is not a public holiday, Saturday or Sunday in our jurisdiction).

Assignment – Either party may not assign or transfer its rights or obligations under this agreement provided that all services and payments are up to date.

Severability – If any of these terms and conditions are determined to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed replaced by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the terms and conditions will continue in effect.

Waiver – Any time or other indulgence granted by us will not in any way amount to a waiver of any of our rights or remedies under this agreement.

No Relationship – We are providing services to you as a consumer and nothing in this agreement should be interpreted to suggest otherwise.

Governing Law – This agreement is governed by the laws of Victoria, Australia and the parties agree to be subject to the jurisdiction of the courts of Victoria, Australia.

Definitions

Administration Charge means the fees charged to you for changes in your enrolment (in limited and exceptional circumstances).

Lifetime Access means online access only to the person who purchased the Program or pattern; and Sew & Tell Australia reserve the right to revoke lifetime access to the Program or pattern, with twelve (12) months’ notice.

Pattern means a sewing pattern you can use, that is in the online, digital or electronic format only and does not include a physical pattern posted to you.

Program means any of the Sew & Tell Australia services including programs, courses, content, associated online exhibitions, patterns, tips, classes, or live sessions.

Services means the same as Program.
